Tired Landlord in Orange County
Why Orange County landlords sell to a cash buyer
Owning a rental in Orange County looks good on paper. Rents are high, vacancies are short, and the land under the house keeps appreciating. The trouble is everything between the rent check and the profit line. A large share of the county's rental stock was built between the 1960s and the 1980s, which means original plumbing, aging roofs, single-pane windows, and electrical panels that insurers and inspectors now flag. Every one of those items is a five-figure repair, and every year the deferred list gets longer.
On top of repair costs, the rules have tightened. California's Tenant Protection Act (AB 1482) caps annual rent increases at 5 percent plus local CPI, never more than 10 percent, on most units older than 15 years. Insurance premiums, property taxes, and contractor rates have no such cap. AB 12, effective July 1, 2024, limits most security deposits to one month's rent, which shrinks the cushion you hold against tenant damage. When rent growth is capped and expenses are not, the margin on an older Orange County rental can go flat or negative even while the property is worth more than ever.
That is the moment many landlords decide to cash out the equity rather than keep feeding the building. SHH Buys Homes is set up for exactly that decision. We buy the property as it stands, tenants and all, and you walk away at closing with the equity in your account.
What Orange County rent rules mean for your sale
Most Orange County cities rely on state law alone, so AB 1482 is the rulebook for the majority of rentals here. It does two things that matter to a seller. First, it limits rent increases as described above. Second, once a tenant has lived in the unit for 12 months, you need "just cause" to end the tenancy, and a no-fault termination such as an owner move-in or withdrawal from the rental market requires relocation assistance equal to one month's rent. A sale is not a just cause. You cannot clear a tenant simply because you want to sell.
Santa Ana is the notable exception. The city adopted its own Rent Stabilization and Just Cause Eviction Ordinance, which applies stricter increase limits and additional procedural requirements to covered units. If your rental is in Santa Ana, those local rules follow the building to the next owner, and any buyer needs to underwrite them. We do.
Two other statutes shape the process. California Civil Code Section 1954 requires 24 hours' written notice before you or a buyer enters an occupied unit, which is why a listing with weekly showings is so hard on tenant relationships. And whatever lease is in place, fixed-term or month-to-month, transfers with the property. A financed retail buyer usually wants the unit empty. We do not. Existing leases, deposits, and any Section 8 Housing Choice Voucher contract simply move to us at closing.
How the sale works with tenants in place
Start by telling us about the property, the current rent, the lease terms, and anything the tenant has complained about. We will make one visit, with proper Section 1954 notice to the tenant, to see the condition for ourselves. That is the only showing. Within 24 hours of that visit you will have a written cash offer.
If you accept, escrow opens with a licensed California title company. Because we are paying cash there is no lender, no appraisal, and no financing contingency, so the timeline is set by how fast title can clear rather than by a bank. We can close in as little as 7 days, or later if you need time to line up a 1031 exchange or coordinate with a partner.
At closing, the tenant's lease, security deposit, and any rent control obligations transfer to us, and we send the new-owner notice required by Civil Code Section 1962. You do not serve any notices, pay any relocation assistance, or wait out a vacancy. You also do not repair anything. Worn carpet, a tired kitchen, a roof on its last decade, an unpermitted patio cover: our offer reflects the property as it is today.
What SHH Buys Homes pays and what you keep
There are no agent commissions in this transaction, and we pay the standard closing costs. The number on our offer is the number that funds through escrow, less whatever is owed on the mortgage and any liens, which title pays off from the proceeds. Because escrow and title are handled by licensed California companies, the tenant's deposit accounting and the payoff of any lender are documented the same way they would be in a traditional sale.
If you plan to reinvest, tell us before we open escrow. We regularly close with 1031 exchange qualified intermediaries and can set the closing date to fit the 45-day identification and 180-day exchange windows. If you are done with real estate, we can close quickly and let you and your tax advisor sort out the rest.

Frequently Asked Questions
Do I have to evict my tenants before selling my Orange County rental?
No. We buy rental property with tenants in place and take over the landlord role at closing. Under AB 1482, a sale is not a just cause for ending a tenancy anyway, so leaving the tenant in place avoids both the legal exposure and the relocation assistance a no-fault termination would require.
Does Santa Ana rent stabilization change your offer?
It changes the underwriting, not our willingness to buy. Santa Ana's Rent Stabilization and Just Cause Eviction Ordinance transfers to the next owner along with the tenancy. We factor the capped rent and the ordinance's requirements into the offer and close on the same timeline as any other Orange County rental.
What happens to the security deposit and the lease?
Both transfer to us. The deposit is credited through escrow, the existing lease stays in force under the same terms, and we send the tenant the new-owner notice required by Civil Code Section 1962. Section 8 Housing Assistance Payments contracts transfer through the housing authority the same way.
How fast can you close on a tenant-occupied property in Orange County?
As little as 7 days from an accepted offer. We pay cash through a licensed California title and escrow company, so there is no lender or appraisal in the way. If you need more time, for example to coordinate a 1031 exchange, we set the closing date around your schedule.
Do you buy duplexes and fourplexes as well as single-family rentals?
Yes. We purchase single-family homes, condos, duplexes, triplexes, and fourplexes throughout Orange County, in any condition and with or without tenants. For buildings of five or more units, call us and we will discuss the property directly.
