Pre-Foreclosure in Orange County
The Orange County foreclosure clock, step by step
Foreclosure in California is non-judicial, so the process runs through recorded notices rather than a courtroom. It starts when your lender records a Notice of Default with the Orange County Clerk-Recorder. From that recording date you have a 90-day reinstatement period under California Civil Code Section 2924c in which you can cure the default by paying the missed payments and fees, or sell the property and pay the loan off in full.
If the default is not cured within 90 days, the lender can record a Notice of Trustee Sale. Under Civil Code Section 2924f, the sale cannot take place sooner than 20 days after that notice is recorded and mailed, which puts the earliest possible auction roughly 111 days after the Notice of Default. Once the trustee's hammer falls, you no longer own the property and any equity above the debt is out of your hands.
The Homeowner Bill of Rights, Civil Code Sections 2923.4 through 2924.19, adds protections along the way: a single point of contact at the servicer, a ban on dual tracking while a complete loan modification application is under review, and a required review of loss mitigation options before the Notice of Default is recorded. Those rules slow the lender down. They do not stop the clock, and they do not put money in your pocket.
You still own the house, and the state says you can sell it
The Notice of Default your lender sends is required by law to tell you, in boldface, that you may still offer your property for sale as long as the sale closes before the foreclosure concludes. That sentence comes from Civil Code Section 2924c, and it is the whole basis of what we do. The full statutory text is quoted on this page below.
Selling during the reinstatement period, or even after a Notice of Trustee Sale is recorded, turns a foreclosure into a regular sale. The lender is paid in full through escrow, the trustee's sale is cancelled, and your credit shows a sale rather than a foreclosure. The late payments already reported stay on your record, but the foreclosure itself, the event that does the most lasting damage, never happens.
Orange County home values make this especially worth doing. A homeowner who bought a decade or more ago often has substantial equity even after missing payments. At auction, the opening bid is set by the lender to cover the debt, and any surplus depends on what bidders are willing to pay that morning on the courthouse steps. In a sale to us, the price is negotiated with you before escrow opens.
How a cash sale beats the trustee sale deadline
A traditional listing takes 30 to 45 days to find a buyer and another 30 to 45 days to close a financed escrow. In the 90-day reinstatement window that is cutting it close; after a Notice of Trustee Sale it is usually impossible. A cash sale removes every step that depends on someone else's lender.
Here is the sequence. Call us or submit the form with your address, the date the Notice of Default was recorded, and the approximate loan balance. We will visit once, and within 24 hours you will have a written cash offer that shows the purchase price, the estimated payoff, and what you should net. If you accept, escrow opens with a licensed California title company. We order the payoff demand from your servicer and the trustee, title clears any junior liens, and we fund. We can close in as little as 7 days.
If a Notice of Trustee Sale has already been recorded, tell us the sale date first. We will open escrow the same day and work backward from the auction. Once the loan is paid, the trustee records a rescission of the Notice of Default and the sale is removed from the calendar.
What you pay, what you keep, and who is involved
You pay no commissions, and we pay the standard closing costs. The house sells as-is, so there are no repairs, no cleaning, and no inspection contingencies that could delay closing past the sale date. The mortgage, any second liens, unpaid HOA dues, and property taxes are paid from the proceeds at closing, and the remaining equity is wired to you or issued as a cashier's check.
If the payoff is close to or above what the house is worth, we can work with the lender on a short sale. That takes lender approval and more time than a straight sale, so the earlier you call, the more options remain. If you have already applied for a loan modification, the dual-tracking rules in the Homeowner Bill of Rights may pause the foreclosure while the servicer reviews it, but a modification and a sale are not mutually exclusive. We can evaluate both paths with you.
The process is private. There is no yard sign, no open house, and no listing on the MLS. Our office is in Upland, and we buy pre-foreclosure homes throughout Orange County, including Anaheim, Santa Ana, Garden Grove, Buena Park, Fullerton, Orange, Huntington Beach, and Costa Mesa. Call (626) 414-4859 as soon as you receive a Notice of Default. Every day you wait narrows the window.
What California law says
“Notwithstanding the fact that your property is in foreclosure, you may offer your property for sale, provided the sale is concluded prior to the conclusion of the foreclosure.”
This sentence is not our opinion. California requires it to appear, in boldface, on the Notice of Default your lender sends you. The state is telling you in writing that you keep the right to sell right up until the trustee sale concludes.

Frequently Asked Questions
Can I sell my Orange County house after a Notice of Default is recorded?
Yes. Civil Code Section 2924c states that you may offer your property for sale provided the sale is concluded before the foreclosure is completed. The Notice of Default is required to tell you this in boldface. We buy homes at every stage before the trustee sale.
How long do I have once the Notice of Default is recorded with the Orange County Clerk-Recorder?
You have a 90-day reinstatement period under Section 2924c. After that the lender may record a Notice of Trustee Sale, and the sale cannot occur sooner than 20 days later under Section 2924f. The earliest auction is therefore about 111 days after the Notice of Default, though many lenders take longer.
What if the trustee sale is already scheduled?
Call us with the sale date. If there is time to open escrow, obtain a payoff demand, and fund, we can still close, and we have done so in as little as 7 days. Once the loan is paid the trustee cancels the sale. If the date is too close, we will tell you honestly rather than open an escrow that cannot close in time.
Will I walk away with money?
If the house is worth more than the loan balance plus liens and fees, yes. At closing the title company pays the lender, the trustee's fees, and any junior liens, and the remaining equity goes to you. If you owe more than the home is worth, we can pursue a short sale with your lender instead.
Does selling stop the foreclosure from appearing on my credit?
A completed sale before the trustee sale means no foreclosure is reported. The missed payments already on your credit file remain, but the foreclosure itself, which stays on a credit report for years and blocks most new mortgage lending, never occurs.
